Benefits of Establishing Paternity
As a mother, establishing paternity can help you receive the necessary child support to properly care for your child. As a father, there are several reasons why you may want to seek paternity. When attempting to gain visitation or custodial rights, establishing that you are the legal father of the child has the potential to greatly improve your case. On the contrary, if you are currently paying child support, and question if the child is yours, establishing paternity can help you avoid the obligation of supporting a child to whom you have no legal responsibilities.
How to Establish Paternity
In the State of New York, there are three ways in which you can establish paternity. Generally, it is assumed that the husband who has a child during the course of his marriage is the biological father of the child. If this is disputed, it can be challenged in Family Court. A Court Order can be made by the judge, in which both parties submit to a DNA test in order to establish the paternity of the child. If a child is conceived out of wedlock, both parents can sign an Acknowledgement of Paternity. This acknowledgement states that the man who conceived the child is the biological father. When signed, the man’s name will be listed on the birth certificate of the child.
No matter what the reason you are seeking the paternity, our office can properly guide you through the process of establishing paternity, and how it can affect your case. The process of establishing paternity is straightforward, due to the simplicity of DNA testing; however, navigating your legal case with the established paternity can be a challenge.
